JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.
The accusation is of making assault to the informant with fists and slaps and lathi and when brother of the informant came to rescue then he was also assaulted. It is submitted by learned counsel for the petitioners that injuries have been found to be superficial, simple in nature. Though the informant has received one incised injury caused by sharp cutting weapon, whereas it is alleged that he was assaulted with lathi and fists and slaps. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

No.53826 of 2015 (2) dt.26-11-2015 2/2 Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj in connection with Bhorey P.S. Case No. 49 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
