The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 414, 467, 468, 34 of the Indian Penal Code.
As per prosecution story, when the informant was on patrolling duty, he arrested the petitioner along with co-accused and recovered a TVS Motorcycle, later on , the same was found stolen motorcycle. During investigation, it was found that the motorcycle belongs to one Ajeet Kumar and in respect of this, he has also lodged Patliputra P.S. Case No. 340 of 2022. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in the present case on the basis of
Patna High Court CR. MISC. No.57804 of 2022(3) dt.17-02-2023 2/2 suspicion. As a matter of fact which is mentioned in para 9 of the petition that the petitioner purchased the said motorcycle from one Prakash Kumar for consideration of Rs. 17,000/- but the police without inquiring the matter implicated the petitioner in the present case and except this no other material is brought on record to show his complicity in the alleged occurrence. It is further submitted that the petitioner is languishing in judicial custody since 22.6.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bodhgayya P.S. Case No. 363 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Gaya. (Sunil Kumar Panwar, J) amandeep/- U T
