In this case, the petitioners are apprehending their arrest in connection with Uchakagaon P.S. Case No. 156 of 2015 (G.R. No. 2708 of 2015) for offence under Section 147, 149, 341, 323, 324, 307, 379 & 504 of the Indian Penal Code. As per allegation made in the First Information Report, when the Informant was returning from the market, four persons have ambushed and an allegation has been made against petitioner no.2, Purendra Ram and petitioner no.3, Soharan Ram to have caused injury to the Informant by sword and Gadasa. Against the
Patna High Court Cr.Misc. No.10046 of 2016 (2) dt.08-03-2016 petitioner no.1, Rinku Devi and petitioner no.2, Manoj Ram, there is no allegation. There is, however, an allegation against petitioner no.2, Manoj Ram of taking Rs. 10,000/-.
Accordingly, the prayer for anticipatory bail of the petitioner nos. 2 & 3, namely, Purendra Ram and Soharan Ram is rejected.
Looking to the entire facts and circumstances of the case, this Court would direct for release of the petitioner no.1, namely, Rinku Devi and petitioner no.4, namely, Manoj Kumar on bail in the event they would surrender within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Gopalganj in connection with Uchakagaon P.S. Case No. 156 of 2015 (G.R. No. 2708 of 2015), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
