The two petitioners being the mother-in-law and Bhainsur of the deceased facing allegation punishable under section 304-B IPC in connection with Kusheshwar Asthan P.S. Case No. 241 of 2015, seek anticipatory bail.

The informant alleged that the deceased was married to the son of petitioner no.1 only a few years ago and thereafter she was consistently being tortured on account of non fulfilment of the demand of dowry. Ultimately, she was done to death in the matrimonial home in suspicious/mysterious circumstances. The learned APP has pointed out that not only the accusation has been made against the petitioners in the FIR but in

Patna High Court Cr.Misc. No.11473 of 2016 (3) dt.23-05-2016 2/2 course of investigation the witnesses have also supported the prosecution case.

Considering the serious nature of the case and the materials collected in course of investigation, I am not persuaded to extend the privilege of anticipatory bail to the petitioners. Their prayer is rejected.
