The petitioners apprehend their arrest in connection with Rajaoun P.S. Case No. 197 of 2015 for the offences punishable under Sections 341, 323, 504 and 506/34 of the Indian Penal Code and Section 3(i) (x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act (hereinafter referred to as the 'SC/ST Act').
Counsel for the petitioner with reference to the FIR submits that the allegations are omnibus and general in nature and whereas apparently no offence under the provisions of the 'SC/ST Act' is made out, insofar as the allegation of physical assault is concerned, no injury is reported.
Patna High Court Cr.Misc. No.55218 of 2015 (2) dt.18-12-2015 Having heard learned counsel for the parties and considering the nature of allegations, let the petitioners, namely,
(1) Fakir Tanti; (2) Manoj Tanti; (3) Amal Tanti; and (4) Kamal Tanti in the event of their arrest or surrender within four weeks from today be released on bail upon each of them furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka and/or the court concerned in connection with Rajaoun P.S. Case No. 197 of 2015, G.R. No. 2007 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
