JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gonaha P.S. Case No. 67 of 2018, registered for the offences punishable under Sections 420, 467, 468, 471, 413, 414 and 34 of the Indian Penal Code.

Allegation as per FIR is that in course of checking of vehicles one Bolero vehicle was intercepted by the police and co-accused Rafik was arrested, who disclosed the name of the petitioner and also stated that three other accused persons, including the petitioner also purchased the Bolero vehicle from co-accused Vikash Ray and Tofik Miyan.

Submission of learned counsel for the petitioner is that there is absolutely nothing against the petitioner except the confessional statement of co-accused and he has no criminal antecedent.

Having heard both sides and in the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if the petitioner surrenders within a period of six weeks and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.

With the above observation, this application is dismissed.
