The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 120B, 34 of the Indian Penal Code and Section 30(d) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 18600 pieces of wrapper meant for pasting on wine bottles alongwith some other articles from one motorcycle and one co-accused namely Rakesh Kumar was apprehended on spot.

It is submitted on behalf of petitioner that name of the petitioner has surfaced on the confessional statement of apprehended co-accused Rakesh Kumar. No incriminating article has been recovered from the conscious possession of this

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner has got criminal antecedent of similar nature of case.
