Petitioner apprehends his arrest in Masrak P.S. Case No. 83 of 2017 instituted for the offence under Section(s) 341, 323, 304, 307, and 302/34 of the Indian Penal Code. There is specific allegation against this petitioner of assaulting the father of the informant with bamboo on the head causing bleeding injury. There is also allegation against coaccused Raghunath Sah of assaulting the cousin brother of the informant namely Kameshwar Pandit on head with bamboo causing serious injury. He subsequently died during treatment. The injury report of the father of the informant has been enclosed with the F.I.R. as Annexure-2, from which, it appears that the doctor has found two injuries on his scalp.(1) Lacerated
Patna High Court Cr.Misc. No.61981 of 2017(3) dt.02-02-2018 2/2 wound over vertex mid line and, (2) a little sized swelling over right parietal region caused by hard and blunt object. Since there is specific allegation against the petitioner, this Court does not find it a fit case for grant of anticipatory bail. Prayer for anticipatory bail is, accordingly, rejected. Petitioner may surrender before the Court below and seek regular bail which will be considered/disposed off on its own merit without being prejudiced by the present order.
