2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 394 of the Indian Penal Code, registered in connection with Akilpur P.S. Case No. 8 of 2021.

3. As per prosecution case, some unknown miscreants intercepted the informant along with his son and on the point of pistol looted his cash, jewellery and other articles.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner is not named in the FIR rather the same has been lodged against unknown person. The name of

No.68516 of 2024(2) dt.07-10-2024 2/2 the petitioner has come into light on the basis of confessional statement of co-accused Kunal Kumar and he has already been granted bail by a Co-ordinate Bench vide order dated 24.04.2023 passed in Cr. Misc. No. 12494 of 2023. No incriminating article has been recovered from the conscious possession of the petitioner and the case of this petitioner stands on better footing. Petitioner is in custody since 04.05.2024.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saran at Chapra in connection with Akilpur P.S. Case No. 08 of 2021, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
