JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-03-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his prayer for bail in connection with Sessions Trial No. 126 of 2014 arising out of Murliganj P.S.Case No. 49 of 2014 registered under Sections 25(1-B)(a), 26 and 35 of the Arms Act.

The prayer for bail of the petitioner was rejected twice by this Court vide orders dated 22.09.2014 and 22.04.2015 passed in Cr. Misc. No. 33657 of 2014 and Cr. Misc. No. 15584 of 2015 respectively.

It has been contended by the learned counsel for the petitioner that though the petitioner is in custody since 03.03.2014, the prosecution has produced only two out of eleven charge-sheet

Patna High Court Cr.Misc. No.10307 of 2016 (2) dt.02-03-2016 2/2 witnesses and hence there is no likelihood of conclusion of the trial in near future.

Regard being had to the stage of the trial, the petitioner Anil Yadav, who is in custody since 03.03.2014, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Sessions Trial No. 126 of 2014 arising out of Murliganj P.S.Case No. 49 of 2014.
