2. The petitioner apprehends arrest in connection with Darauli P.S. Case No. 191 of 2023 dated 12.07.2023, instituted for the offence punishable under Sections 30(a) of the Bihar Prohibition of Excise Act 2016.

3. Allegation is recovery of 30 cartoons each containing 45 pieces of 200 ml country-made liquor, in total 270 litres, from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It is submitted that nothing has been recovered from the conscious possession of the petitioner. Lastly, it has been submitted that the petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Since the 270 litres of country-made liquor has been recovered from the house of petitioner, I am not inclined to grant the anticipatory bail to the petitioner.

7. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
