JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 380, 448, 452, 504 and 506/34 of the Indian Penal Code.

It is alleged by the informant that while he was going to sleep then the accused persons came to his house and on the point of pistol looted the cash and ornaments, assaulted and threatened. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that all offences are bailable except offence under Sections 380 and 452 IPC. The petitioner is the agnate of the informant. There is admitted land dispute between the parties and for the said reason present prosecution has been lodged.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in Motihari Mufasil P.S.Case No. 419 of 2015/ G.R.Case No. 6623 of 2015,subject to the conditions as laid down u/s 438(2) Cr.P.C.
