The petitioner has been arrested in connection with Kharik P.S. Case No. 51 of 2015 registered under Sections 147,148,149,447, 323, 324, 325, 386, 387, 307, 379, 120B/504 and 506 of Indian Penal Code as well as Section 27 of the Arms Act.
There is allegation that this petitioner along with others came having fire arms and they opened fire causing injury to the informant and others.
However, injury report of the informant is not in the case diary. Though, there are injury reports of some persons like Saurab Kumar, Subhash Singh and Bimal Singh, but injury on the
Patna High Court Cr.Misc. No.54357 of 2015 (3) dt.12-02-2016 persons shown to be hard and blunt substance and injuries are simple in nature.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Naugachia, District-Bhagalpur, in connection with Kharik P.S. Case No. 51 of 2015, subject to condition that one of the bailors shall be near relative of the petitioner who will file an affidavit to this effect that except this case the petitioner has been made accused in six cases. Further condition that petitioner shall not indulge in such activity in future. m.p.
