JUSTICE SANJAY PRIYA ORAL ORDER 5/ 15-05-2018 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 24.01.2013 passed by the District and Sessions Judge, Saharsa in Criminal Revision No.151 of 2012, whereby he has dismissed the revision application as well as for quashing the order dated 26.03.2012 passed by the SDJM, Birpur, in Birpur P.S. Case No. 64 of 2011 by which he has taken cognizance against the petitioner and others for the offence under Section(s) 341, 323, 504, and 379/34 of Indian Penal Code.

After some argument, learned counsel for the petitioner seeks permission to withdraw this application to raise all the points, as raised in the instant application, at the time of

Patna High Court Cr.Misc. No.30158 of 2014 (5) dt.15-05-2018 2/2 framing of charge in the Court below.

This application is, accordingly, dismissed as withdrawn with the liberty as aforesaid.
