Learned counsel for the petitioners are permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks on resumption of physical mode. The Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code, 1860.

The petitioners and co-accused persons are said to have kidnapped the victim for the purpose of marriage. Learned counsel for the petitioners has submitted that

Patna High Court CR. MISC. No.71004 of 2021(2) dt.08-06-2022 2/2 the victim in her statement recorded under Section 164, has not stated the name of the petitioners. She married the petitioner and she was blessed with one son. She is living with the petitioner of own her will and nobody is involved in her abduction. The petitioners have no criminal antecedent. Learned A.P.P. for the State has opposed the bail petition of the petitioners. The impugned order suggest that the victim is minor.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Nawada in connection with Kauwakol (Rupo) P.S. Case No. 14 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
