Petitioner is accused in connection with S. Tr. No. 739 of 2015 arising out of Ahiypur P.S. Case No. 499 of 2015 registered under Sections 399, 402, 414 of the I.P.C. and section 25(1-B)A/26 and 35 of the Arms Act.
On receiving the secret information about gathering of the criminals to commit bank dacoity, the police reached near SKMCH where 7 persons were seen with three motorcycles, on seeing the police party they started to flee away but four persons including the petitioner were apprehended. On search, one country made pistol was recovered from the possession of the petitioner, whereas from the possession of Shanker Sahni, one black colour
Patna High Court Cr.Misc. No.56312 of 2015 (2) dt.16-12-2015 2/2 motorcycle and two live cartridges, one red colour motorcycle from Arun Sahni and one mobile and one dagger were recovered from the possession of Vickey Mahto.
Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case by the Police mere on suspicion. It is also submitted that petitioner has no criminal antecedent and is in custody since 12.06.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Muzaffarpur in connection with Trial No. 739 of 2015 arising out of Ahiyapur P.S. Case No. 499 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner, who will also file an affidavit showing his relation with the petitioner.
