The petitioner apprehends his arrest in connection with Bettiah (Town) P.S. Case No.292 of 2019/G.R. No.1452 of 2019 registered under Sections 366(A) and 120(B) of the Indian Penal Code and, later on, added Section 8 of the POSCO Act. The accusation is of kidnapping the daughter of the informant from her maternal house by Sartaj Alam with the help of others to perform the marriage.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. In fact, he being the brother-inlaw of Sartaj Alam has falsely been implicated in this case in course of investigation. In her statement recorded under Section 164 of the Code of Criminal Procedure, the daughter of the informant clearly

No.57862 of 2019(2) dt.17-09-2019 2/2 stated that she moved with Sartaj according to her own sweet will and went to Delhi, from where, under conspiracy, they were called by the brother-in-law (petitioner), father and friends of Sartaj. Govind got managed to escape Sartaj after pushing him from the train and started to tease her and, thereafter, confined her in the house of Sartaj. The daughter of the informant disclosed the name of the petitioner only saying that she and Sartaj was called by him and others.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah (Town) P.S. Case No.292 of 2019/G.R. No.1452 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
