1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 109(1) and 352 of the BNS.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that on 30.04.2025 Pintu Gond was constructing his house on a land for which a civil suit is pending. On objection, Pintu Gond assaulted the informant by farsa causing injury on his head. Thereafter, petitioner assaulted him by an iron rod causing injury on shoulder and hand on account of which he became unconscious. Further, the wife of Pintu Gond assaulted Awdesh Gond by rod and petitioner also assaulted Fulbadan Gond by rod causing injury on head and hand while Sharda Devi assaulted

Patna High Court CR. MISC. No.59946 of 2025(2) dt.11-09-2025 2/3 Gharbharan Gond by spade causing injury on hand and leg. Further, Bilari Kumari and others assaulted the informant by lathi and danda.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to land, the occurrence is alleged to have taken place. It is next submitted that an altercation had taken place in between Pintu Gond and the informant when people from both sides gathered and assaulted each other. It is also submitted that no doubt there is allegation of assault against the petitioner also but then all injuries suffered by the injured have been opined to be simple in nature which amply demonstrates that accused persons including the petitioner never had any intention of committing a serious occurrence. It is submitted that from the side of the petitioner also people got injured for which Piprasi P.S. Case No. 37 of 2025 has been instituted, as such, the instant FIR is a counterblast.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned

No.59946 of 2025(2) dt.11-09-2025 3/3 counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Piprasi P.S. Case No. 38 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
