JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-01-2021 Heard the learned counsel for the petitioner and Sri Narendra Kr. Singh, the learned AC to GP 22, who has submitted that the entire Provident Fund amount along with interest has already been paid and to that effect, he has referred to Annexure-R/A which is the order issued by the G.P.F. Office, Patna dated 26.06.2018.

The learned counsel for the respondents has further submitted that the succession certificate was submitted by the petitioner on 16.04.2018, whereafter G.P.F. payment order has been issued immediately.

It would suffice to note that the petitioner has

Patna High Court CWJC No.17781 of 2019(4) dt.21-01-2021 2/3 approached this Court only for issuance of directions to the respondents to pay interest on the delayed payment of the G.P.F. amount. It is also not in dispute that as far as G.P.F. amount is concerned, interest is to be calculated and paid up to the date of payment.

At this juncture, the learned counsel for the respondents has referred to the aforesaid G.P.F. payment order dated 26.06.2018 and submitted that the interest has been paid up to the date of payment.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present petition, however with a direction to the respondentauthorities specially the District Provident Fund Officer, Patna as also the Assistant Registrar, Co-operative Society, Danapur Anchal, Patna ie. the respondent no. 3 to re-calculate and ensure that interest on the G.P.F. amount has been paid up to the date of payment and in case, it is found that the same has not been paid, the same is directed to be paid forthwith. It is needless to state that the aforesaid exercise should be carried out within a period of four weeks from today, failing which the District Provident Fund Officer, Patna and the
