JUSTICE SUDHIR SINGH ORAL ORDER 11-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323 and 504/34 of the Indian Penal Code and 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (hereinafter referred to as 'SC and ST Act').
Allegation against the petitioners is that they did not make payment to the informant in lieu of work he had done. They assaulted informant and also abused him by calling his caste name. It is submitted on behalf of the petitioners that they have falsely been implicated in the present case. It is a case and counter case between the parties. All the Sections are bailable except for offence under SC and ST Act. As far as provisions of SC and ST Act is concerned, same is not attracted in the present case. On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the
Patna High Court Cr.Misc. No.54788 of 2015 (2) dt.11-03-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Ravi Shankar, learned Judicial Magistrate, Ist Class, Madhubani, in connection with Ladaniya P.S. Case no. 54 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
