The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 33, 41, 42 and 52 of the Indian Forest Act.
The prosecution case is that petitioner no. 1, Manish Kumar and other co-accused persons were apprehended while carrying logs of forest wood, on two bicycle. Thereafter, petitioner no.1 was taken under custody near CRPF camp but the other co-accused persons attacked the police officials and succeeded to get petitioner no.1 freed from the custody, for which a separate case was lodged. It is submitted by learned Counsel appearing on
Patna High Court Cr.Misc. No.59856 of 2017(2) dt.12-12-2017 2/2 behalf of the petitioner that nothing has been recovered from the possession of the petitioner and only on suspicion the accusation has been levelled while the other co-accused has been granted anticipatory bail by the learned Court below itself.
Considering the nature of accusation in view of this Court, it is a case for consideration for prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Forest Case No. 29 of 2017, pending before the learned ACJM, Kaimur at Bhabua.
With the above observation, this application is, accordingly, disposed of.
