2. The petitioner seeks regular bail in connection with Sri Nagar P.S. Case No. 85 of 2020, lodged on 26.11.2020 under Sections 302, 34 of the Indian Penal Code.

3. As per the prosecution case, FIR has been lodged against three named accused persons including the present petitioner against whom there is an allegation that they have killed the sister of the informant by strangulating her neck.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the antecedent of the petitioner is clean and he is in custody since 27.11.2020. Counsel further submits that after framing of charge, total seven prosecution witnesses were

No.60389 of 2023(5) dt.27-02-2024 2/2 examined and out of those seven prosecution witnesses, four witnesses became hostile and one witness has stated that he is heresay witness and two witnesses not supported the prosecution version. The said evidence of PW's has been attached in this bail application by virtue of supplementary affidavit.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 3rd,Madhepura in connection with Sri Nagar P.S. Case No. 85 of 2020, subject to the conditions as laid down U/s 437(3) Cr.P.C.
