====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 16-11-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Deepnagar P.S. Case No. 149 of 2019 for the offence registered under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioners submits that allegation against the petitioners is made out under Section 323 as no intervening circumstances has been enumerated to prevent repetition of blows, so that it is submitted that no specific role has been attributed to the present petitioners and the charge is general and omnibus in nature. Considering the aforementioned facts and circumstances and that the petitioners have clean antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned I/C Chief Judicial Magistrate, Nalanda, in connection with Deepnagar P.S. Case No. 149 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
