JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This is an application for grant of anticipatory bail in connection with Town P. S. Case No. 170 of 2019, disclosing offences under Sections 448, 323, 384, 387, 504, 506, 379, 34 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R. petitioner and other accused persons came to the shop of the informant armed with pistol and other weapons abused the informant and demanded Rangdari from him and also threatened him. Further allegation against coaccused is of snatching his chain. Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against him and though the petitioner is accused in two other cases, but in one case he is not named in the F.I.R. and in the other case he is on
Patna High Court CR. MISC. No.55075 of 2019(3) dt.15-10-2019 2/2 bail. Further submission is that there is delay of four days in lodging the F.I.R. and there is no allegation of assault against this petitioner. During the investigation, the witnesses have also not supported the prosecution case.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Town P.
