The petitioner apprehends his arrest in connection with Buniyadganj P.S. Case no. 121 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that in course of patrolling duty, the informant along with other Police personnel reached at the bank of Falgu river and started searching nearby area. On seeing the Police personnel, four persons started to flee away, but on chase out of four, three persons were apprehended, who disclosed their names Sanjay Manjhi, Kedar Manjhi and Bhaju Manjhi. On search, 50 liters of country made liquor, 100 Kg Mahua flower along with one gas cylinder and other manufacturing apparatus were recovered. The apprehended

Patna High Court CR. MISC. No.56347 of 2019(2) dt.05-09-2019 2/2 person disclosed the name of petitioner, who succeeded to flee away.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner was not apprehended on the spot rather, his name has come in the confessional statement of co-accused, who are said to be apprehended on the bank of Falgu river from where 50 Kg of country made liquor is said to be recovered. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Excise Judge, Gaya in connection with Buniyadganj P.S. Case No. 121 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
