JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 28.12.2010 and admittedly, up till now, his trial could not be concluded. Petitioner is named in the first information report without any specific overtact. No doubt, petitioner carries criminal antecedent of several cases but having more or less similar allegation, co-accused, Surendra Yadav @ Bhurkhund @ Rausan Jee and Chandra Shekhar Azad @ Chandan Kumar @ Chandan Mahto have already been granted privilege of bail by this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand)

Patna High Court Cr.Misc. No.26021 of 2014 (4) dt.06-08-2015 2/2 with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Amas P.S. Case No. 32 of 2010, subject to condition that petitioner shall give his attendance before the Officer in Charge of Amas police station in the first week of each month till conclusion of his trial, failing which the Officer in Charge of Amas police station shall send a report to concerned court and having receipt of the report, the concerned court shall be at liberty to cancel the bail bonds of the petitioner. Furthermore, the concerned court must communicate the order of this Court to the Officer in Charge of Amas police station within a week from the date of receipt/production of copy of this order.
