JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sonepur P.S. Case No. 216 of 2017, registered for the offences punishable under Sections 399,402/34 of the Indian Penal Code and Section 25 (1-b) a, 26 of the Arms Act. Name of the petitioner transpires in the confessional statement of co-accused, F.I.R lodged with respect to preparation of committing dacoity. Three persons were apprehended and Arms and ammunition were recovered from them. They disclosed the name of the petitioner. Submission of the learned counsel for the petitioner is that no occurrence took place. Moreover, nothing has been recovered from the physical possession of the petitioner. He has no criminal antecedent.

No.55159 of 2019(2) dt.02-09-2019 2/2 In view of the above facts and circumstances, let petitioner, above named in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Chapra, in connection with Sonepur P.S. Case No.216 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned and he will appear before the police as and when required by the I.O.
