2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 452, 307, 504, 506 of the Indian Penal Code and Section 27 of Arms Act.

3. As per prosecution case, the petitioner along with others came at the house of the informant and started abusing them. During this court, co-accused Gulshan Yadav fired at left hand of the informant's son and the petitioner is said to have also fired above the wrist of the son of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to dirty village politics.

Other co-accused Gulshan Yadav who has also specifically be alleged to fired upon the informant, was already enlarged on bail granted by a co-ordinate Bench of the Court vide order dt. 22.9.2022 passed in Cr. Misc. No. 36602 of 2022 which is evident from Annexure-3. It is further submitted that the petitioner is languishing in judicial custody since 15.6.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Kasim Bazar P.S. Case No. 135 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger.
