Learned counsel for the petitioner, at the outset, submits that the instant writ application has been filed seeking restoration of Cr. Misc No. 47773 of 2017 which stood dismissed for non-prosecution by order dated 23-11-2023. 3.

On query of the Court with regard to the stage of case, it is fairly submitted that the order of cognizance was impugned in Cr. Misc No. 47773 of 2017, but thereafter the stage has changed, charges have been framed, trial has
