JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was earlier granted privilege of anticipatory bail by a coordinate bench of this court but subsequently, the aforesaid bench recalled its order on the ground that petitioner has suppressed some important facts. Though petitioner is named but admittedly, the victim returned to his home safely and the victim has nowhere stated the name of the petitioner in his statement recorded u/S 164 of the Cr. P.C. It is an admitted position that the victim and the petitioner are co-villagers. The petitioner does not have any criminal antecedent.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten
Patna High Court Cr.Misc. No.54339 of 2015 (2) dt.07-12-2015 2/2 thousand) with two sureties of the like amount each in connection with Karjain P.S. Case No. 69 of 2011 to the satisfaction of learned Sub Divisional Judicial Magistrate, Birpur, Supaul. (Hemant Kumar Srivastava, J) A.K.V./- U T
