The petitioner apprehends arrest in connection with Shastri Nagar P.S. Case No. 58 of 2018 (Spl. Case No. 5578 of 2021) registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of seizure list, it is evident that the recovery has been made from the Hut. Petitioner has no concern with the hut in question. Further he submits that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

No. 69644 of 2021(2) dt.29-04-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise Act, Patna in connection with Shastri Nagar P.S. Case No. 58 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
