The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(a) of the Excise Act. It is alleged that from the hutment of the petitioner twenty bottles of 200 ml. each country made liquor were recovered.

It is submitted by learned counsel for the petitioner that there is nothing on the record to suggest that the hutment belong to the petitioner.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.54640 of 2015 (2) dt.02-12-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna City in connection with Fatuha P.S. Case No. 308 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
