JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 353, 379, 411, 120B of the Indian Penal Code, Rule 40(1) the Bihar Minor Mineral Concession Rules, 1972, sections 33,41,42 of the Indian Forest Act and 4(1-a),21(1) of The Mines & Minerals (Development & Regulation) Act.
The prosecution case is that on secret informant the informant being officer I/c Sanjhauli intercepted a truck loaded with stone chips. In the meantime, a car came there and passengers of that car obstructed the seizure of the truck. The informant also came to know that another truck passing through Sanjhauli police station also met with an accident. Subsequently, it was found that the petitioner was driver of the truck which met with an accident.

No.54187 of 2015 (2) dt.30-11-2015 2/2 It is submitted by learned counsel for the petitioner that stone chips were being transported under the valid permit and other co-accused persons have been granted anticipatory bail by the learned court below. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for four months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Bikramganj in connection with Sanjhauli P.S. Case No.
66 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioner will be confirmed by the learned court below on verification of the fact that the stones chips were being transported under the valid permit. But, if it is found otherwise then the petitioner will surrender and pray for regular bail.
