JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 02.11.2015 in a case registered for the offences punishable under sections 20 and 22 of the NDPS Act.
From the possession of petitioner 7 grams of smack were recovered.
It is submitted by learned counsel for the petitioner that weight of seized contraband mentioned in the prosecution report is speculative and the recovery is slightly above the small quantity. The petitioner has no criminal antecedent. Statement to that effect has been made in paragraph 3 of the petition which reads thus:- "3. That the petitioner has got no criminal antecedent." Learned counsel for the State has not disputed the aforesaid facts.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Vaishali at Hajipur in connection with Industrial Area, Hajipur P.S. Case No. 116 of 2015.
