27.04.2016 Heard learned counsel for the Petitioners and the State.
The Petitioners are apprehending their arrest in Raxaul P.S. Case No. 108 of 2014 registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code and Section 3(i)(x) of the SC/ST (POA) Act pending before the Subdivisional Judicial Magistrate, Raxaul, East Champaran. It has been submitted that it was on account of misconception that the Petitioners withdrew the application for anticipatory bail and, hence, they have filed fresh anticipatory bail.
Considering the nature of allegations against the Petitioners, I am not inclined to extend the privilege of anticipatory bail to them. The prayer for anticipatory bail is rejected.
