JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kadamkuan P.S. Case no. 220 of 2016, registered under Sections 341, 323, 379 and 504/34 of the Indian Penal Code. The accusations is that on 26.05.2016 at about 7.10 A.M. informant was in his house at that time petitioner reached there and told to close the shop of Chowmin on which informant made protest thereafter petitioner started to abuse and caused injury through iron rod at the head of the informant, when informant hold the iron rod then Pintu Sahani caught hold the hands of the informant and petitioner again caused injury at his head and he has also snatched golden chain from his neck.

Learned counsel for the petitioner submits that, in fact,

No.19097 of 2017 (3) dt.12-10-2017 2/2 the petitioner is the maternal uncle of the informant and due to some dispute hot talks were exchanged and present case has been lodged. Moreover, only one injury was found on the head of the informant and nature of injury has not been detected.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna in connection with Kadamkuan P.S. Case No. 220 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
