JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 12-12-2017 Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 342, 323, 427, 387, 504 and 506 of the Indian Penal Code.
The prosecution case is that the petitioners used to demand extortion of Rs. One lakh for allowing the informant to cultivate the land in question.
It is submitted by learned counsel for the petitioners that the petitioners are claiming the land in question
Patna High Court Cr.Misc. No.59946 of 2017 (2) dt.12-12-2017 2/2 on the basis of a sale deed executed in favour of the petitioners by the ancestors of the informant in 1949, whereas the informant is claiming the land on the basis of sale deed executed in 2016. A statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent. Considering the accusation levelled in the background of serious land dispute, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, District - West Champaran in connection with Nadi P.S. Case No. 35 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
