Petitioner, namely, Laxman Singh is in custody in Bhagwan Bazar P.S. Case No.138 of 2015 under Sections 341, 323, 380, 307, 354/34 of the Indian Penal Code. The allegation is that the petitioner tied a rope in the neck of the informant's wife with intention to kill her but she was saved by the informant.

The learned counsel submitted that there are minor injuries in the neck and both parties are next door neighbours and without any rhyme and reason this false case has been lodged because there was strained relationship between them. On the other hand, the learned A.P.P. objected the

Patna High Court Cr.Misc. No.55761 of 2015 (2) dt.17-12-2015 prayer for bail.

Perused the injury report, which is Annexure-2. Perused the F.I.R.

Considering the nature of allegation and the injury I direct that the petitioner named above be released on bail on furnishing bail bond of Rs.5,000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No.138 of 2015.
