The petitioner seeks bail in connection with Kumarkhand P.S. Case No. 140 of 2018 instituted for the offence under Section(s) 395 of the Indian Penal Code. It is alleged that few miscreants snatched cash, mobile phone etc. from possession of informant. In the written report, it is alleged that petitioner was apprehended on the spot. But, there is no recovery of any incriminating article from possession of this petitioner. Seizure list is part of the FIR. From perusal of the seizure list it appears that alleged mobile set which is said to have been recovered from possession of this petitioner does not tally with the description given by the informant in the written

The petitioner is in custody since 17.7.2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 140 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/mu keshU T
