JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 353, 447, 427 and 379/504 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that the informant was posted as In-charge Headmaster in the Middle School, Vijay Nagar, Jamalpur. On 03.07.2015 when the science teacher entered into the class room he found that student Lalan Kumar and Minti Kumari were quarreling then science teacher tried to pacify thereafter Minti Kumari went home with her bags and after sometime Minti Kumari came with her parents and other family members including the petitioners when the informant was assaulted with fists and slaps and `10,000/- was taken away.

Patna High Court Cr.Misc. No.56805 of 2015 (2) dt.16-12-2015 2/2 It is submitted by learned counsel for the petitioner that for the petty dispute, the accusation has been levelled. There is no specific accusation against the petitioner. For the occurrence of 03.07.2015, the FIR was lodged on 10.07.2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case and the petitioner being a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Munger in connection with SC/ST P.S. Case No. 19 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
