ANJANA MISHRA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner, Informant and learned counsel appearing on behalf of the State. The petitioner apprehends his arrest in connection with Tarapur P.S. Case No. 40 of 2015 for the offences registered under Sections 363 and 364 of the Indian Penal Code. Learned counsel for the petitioner submits that the entire case is false and fabricated. Actually, the victim girl was thrown out by her husband (informant) and as a result of which, she accompanied with one Chanda Devi and went to Delhi where she was working as a Maid Servant for earning her livelihood. It is further submitted that when she came back, she has made a statement under Section 164 Cr.P.C. to the said effect.

In view of the aforesaid facts and circumstances of the case and the statement made by the victim girl under Section 164 Cr.P.C. let the petitioner, above named, in the event of his arrest or

Patna High Court Cr.Misc. No.54580 of 2015 (8) dt.21-06-2016 surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Tarapur P.S. Case No. 40 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
