Petitioner seeks regular bail in connection with Tandwa PS Case No. 36 / 2021 registered for the offence under Sections 379 of the IPC and later on Section 411 of the IPC was added.

The motorcycle of the informant was stolen from near the temple and the same has been recovered after two months from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent of similar nature of offence, he is custody custody since 13/08/2021 and case is triable by Magistrate.

Regard being had to the submissions made by the

Patna High Court CR. MISC. No.69787 of 2021(2) dt.25-05-2022 2/2 parties, taking into consideration the material on record, the fact that petitioner has got no criminal antecedent of similar nature of offence, case is triable by Magistrate and petitioner is in custody since 13/08/2021, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Aurangabad in connection with Tandwa PS Case No. 36 / 2021.
