The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

As per the prosecution case, all the FIR named accused persons including petitioner committed theft in the house of informant's father and took away ornaments and household items worth Rs. 70,000/-.

It is submitted that from bare perusal of FIR it is apparent that informant got informant of theft in her father's house from neighbour Ankit Kumar Soni. No incriminating article has been recovered from possession of this petitioner.

Patna High Court CR. MISC. No.69721 of 2021(4) dt.17-10-2022 2/2 Informant is not eye-witness of the occurrence. Similarly situated co-accused Paltu Mahto has been granted bail by this Court. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Bikramganj, Rohtas in connection with Rajpur P.S. Case No. 84 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
