====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 11-01-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Khutauna P.S. Case No.50 of 2015 registered under Sections 147, 148, 149, 323, 302 and 120(B) of the Indian Penal Code. The accusation is of carrying the deceased to the house of the co-accused, Banshi Lal Sah, and causing assault to him due to which he died. The informant named the petitioner and 9 others involved in the commission of the alleged occurrence. Learned counsel appearing on behalf of the petitioner submits that the petitioner is the relative of the co-accused, Banshi Lal Sah and at the time of alleged occurrence, the petitioner was at

Patna High Court Cr.Misc. No.55397 of 2015 (2) dt.11-01-2016 2/2 Madhepura, 100 kilometers away from the place of occurrence village, but due to ulterior motive being the relative of the coaccused, Banshi Lal Sah, the petitioner has falsely been implicated in this case. The petitioner having no criminal antecedent is in custody since 26.06.2015. It is further submitted that the coaccused, Amit Kumar Sah, who is also relative of the co-accused, Banshi Lal Sah, has already been granted bail by a coordinate Bench of this Court vide order dated 18.12.2015 passed in Criminal Misc. No.42717 of 2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Jhanjharpur, Madhubani, in connection with Khutauna P.S. Case No.50 of 2015.
