The petitioner apprehend his arrest in connection with Hajipur Sadar P.S. Case No. 331 of 2017, registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The police got information that three persons were going on a motorcycle with an object to commit offence. The police intercepted the said vehicle and arrested one person, namely, Shyam Babu. The other accused persons including the petitioner managed to flee away. From the possession of said Shyam Babu, arms and ammunitions were recovered.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the

No.56911 of 2017 (3) dt.18-12-2017 2/2 petitioner and the name of the petitioner figured in the case on the basis of the confessional statement made by said Shyam Babu, but it appears that the petitioner has got criminal antecedent and he is accused in as many as three cases, registered for the offences punishable under Sections 380, 384, 411 and other sections of the Indian Penal Code. Considering the fact that the petitioner has got criminal antecedent, I do not find it a fit case for grant of anticipatory bail. The same is, accordingly, rejected. If the petitioner, above named, surrenders before the court below, his prayer for regular bail shall be considered on its own merit without being prejudiced by the order of this Court.
