The petitioner apprehends his arrest in connection with Rajnagar P.S. Case No.320 of 2017 registered under Sections 420, 467, 468, 471, 401, 411 and 414 of the Indian Penal Code.

The accusation is that in course of patrolling duty, the informant along with other police personnel tried to stop the riders of two motorcycles but on seeing the police party, they started to flee away. On chase, they were apprehended and the person, who was on black colour Splender Motorcycle having no number plate disclosed his name as Amit Ranjan and the persons, who were on Hero Splender Motorcycle bearing

Patna High Court CR. MISC. No.54756 of 2019(2) dt.30-08-2019 2/3 Registration No.06AG-4169 disclosed their name as Anmol Kumar (rider) and Vikky Kumar (pillion rider). On query, they disclosed that they are the students of Sandip Foundation but they could not produce any paper regarding the motorcycles and also disclosed that both the motorcycles have been stolen from Darbhanga. They also disclosed that the other motorcycles, which have been stolen from the University Police Station, Darbhanga, are with their associates. They also disclosed the name of the petitioner and others saying that they used to help them in committing of the theft of the motorcycles.

Learned counsel for the petitioner submits that, on investigation, the police has submitted final form against the petitioner and some other co-accused but the learned court differing with the final form took the cognizance of the offence against them. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Madhubani, in connection with Rajnagar P.S. Case No.
