JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant claims in his written report that he came to know about the alleged occurrence from the victim who happens to be her daughter. The statement of victim was recorded under Section 164 of the Cr.P.C. in which she stated that it was co-accused, Ranjit Kumar who committed rape on her and so far as petitioner is concerned, petitioner came on the place of occurrence later on and thereafter, brought the victim to his home from where she was picked up by her brother.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.55164 of 2015 (2) dt.11-12-2015 2/2 two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Madhepura in connection with Mahila Madhepura P.S. Case No. 14 of 2014.
