2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 354B, 380, 427, 452 of the Indian Penal Code and later on Section 302 IPC was added.

3. As per allegation in the FIR, petitioner and coaccused persons holding knife, pistol and iron rod entered into the house of the informant and accused Pradeep Sahni assaulted the informant's father with with the butt of pistol and Ranjeet Sahni also assaulted on his father's head by means of iron rod causing head injury.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner

Patna High Court CR. MISC. No.63251 of 2023(2) dt.10-10-2023 2/2 is not named in the FIR. Even petitioner was not member of mob. Several similarly situated accused persons have already been enlarged on bail vide order dated 4.8.2023 passed in Cr. Misc. No. 363 of 2023. Petitioner has got no criminal antecedent and languishing in judicial custody since 8.3.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Darbhanga in connection with Singhwara P.S. Case No. 97 of 2022.
