JUSTICE SUDHIR SINGH ORAL ORDER 16-01-2018 Heard learned counsel for the petitioners, learned counsel appearing for the State and learned counsel for the informant.
The petitioners are apprehending their arrest in a case instituted under Sections 498A, 304B/34 of the Indian Penal Code. The allegation against the petitioners is of committing murder of the deceased due to non-fulfillment of the demand of dowry.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioners are father-in-law and mother-in-law
Patna High Court Cr.Misc. No.62964 of 2017 (3) dt.16-01-2018 2/2 of the deceased. They are separate in mess and property from the husband of the deceased.
On behalf of the State and counsel for the informant, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Tajpur (Halai O.P.) P.S.Case No.199 of 2017, on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
