====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-02-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Sitamarhi G. O. Case No. 165 of 2021 registered under Section 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 01.10.2021, he is a person with clean antecedent and prosecution report has been submitted in this case.

Allegation is of recovery of 81 liters of liquor from the luggage of the petitioner from Nepal border. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No. 69602 of 2021(2) dt.25-02-2022 2/2 petitioner has been falsely implicated in this case. The main culprit fled away after throwing his luggage and the petitioner came to be implicated when search was being made as he was passer by.

Learned APP for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 01.10.2021, he is a person with clean antecedent and prosecution report has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 2,000/- (two thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-Special Judge (Excise), Sitamarhi in connection with Sitamarhi G.O. Case No. 165 of 2021. The application stands allowed.
